Terms of Service

1. Agreement to Terms
By accessing or using Orbitable (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These terms constitute a legally binding agreement between you and Orbitable.
2. Service Description
Orbitable provides an autonomous marketing command centre featuring specialist agents that research, create, and execute marketing activities on your behalf. The service includes specialist agents, workflow automation, image generation, and multi-agent orchestration.
3. Account Registration
To use the Service, you must create an account through Replit authentication. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Accept responsibility for all activity under your account
- Notify us immediately of any unauthorised access
You must be at least 18 years old to create an account and use the Service.
4. Subscriptions and Billing
Plans: The Service is offered through paid subscription plans (Starter, Growth, Agency) with varying usage limits and features. A valid subscription is required to access the platform.
Billing: Subscriptions are billed monthly or annually through Stripe. Payment is due at the start of each billing period. All fees are in US Dollars and are non-refundable except as described below.
Usage Limits: Each plan includes a monthly allowance covering agent messages, image generations, and other resources. Allowances reset at the start of each billing cycle and unused capacity does not roll over.
Plan Changes: You may upgrade your plan at any time, with prorated charges applied immediately. Downgrades take effect at the end of the current billing period. You can manage your subscription through the Stripe Customer Portal accessible from your account settings.
Cancellation: You may cancel your subscription at any time through the Stripe Customer Portal. Upon cancellation, your access continues until the end of the current billing period. After that, your account transitions to an inactive state and access to the dashboard is suspended.
Reactivation: If your subscription expires or is cancelled, you may reactivate by choosing a new plan. Your existing data (worlds, agent history, outputs) is retained for 90 days after cancellation.
5. Acceptable Use
You agree not to use the Service to:
- Generate spam, misleading content, or phishing material
- Create content that violates applicable laws or regulations
- Impersonate individuals, companies, or organisations
- Attempt to circumvent usage limits or security measures
- Reverse-engineer, decompile, or disassemble any part of the Service
- Use automated methods to access the Service outside of approved APIs
You are solely responsible for reviewing and approving all agent-generated content before publishing or distributing it.
6. Intellectual Property
Your Content: Content generated by AI agents for your business belongs to you. You retain all rights to your business data, marketing materials, and agent outputs.
Our Platform: The Orbitable platform, including its design, code, AI agents, workflows, and technology, is our intellectual property. You are granted a limited, non-exclusive, non-transferable licence to use the Service for the duration of your subscription.
7. AI-Generated Content
AI-generated content is produced by machine learning models and may contain errors, inaccuracies, or biases. You acknowledge that:
- AI outputs should be reviewed by a human before use
- We do not guarantee the accuracy, completeness, or suitability of any AI-generated content
- You are responsible for ensuring generated content complies with applicable laws, advertising standards, and industry regulations
- Image generation results may vary and are subject to the capabilities and limitations of underlying models
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. The Service depends on third-party providers (Anthropic, Stripe, Replit) and may be subject to downtime, maintenance windows, or service disruptions outside our control.
9. Limitation of Liability
To the maximum extent permitted by law, Orbitable shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:
- Loss of profits, revenue, or business opportunities
- Errors or inaccuracies in AI-generated content
- Service interruptions or data loss
- Unauthorised access to your account
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Orbitable from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
